Terms of Service
Effective Date: October 24, 2026 · Version 2.10.0
Welcome to SnowLawn. By accessing or using the SnowLawn platform ("Platform"), operated by WINDHAMTECH LLC ("SnowLawn", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use the Platform. By creating an account, you represent and warrant that you meet these requirements. If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
2. Platform Role & Facilitation Only
SnowLawn is a technology platform that solely facilitates transactions between customers seeking snow removal, lawn care, and related services ("Customers") and independent service providers offering such services ("Providers").
SnowLawn does not itself provide, perform, or guarantee any snow removal, lawn care, landscaping, or other physical services. SnowLawn is not a contractor, subcontractor, employer, or agent of any Provider. The Platform — the SnowLawn website and the SnowLawn apps for iOS and Android — serves only as a marketplace to connect Customers and Providers.
2b. Relationship of Parties
Nothing in these Terms shall be construed as creating a joint venture, partnership, employment relationship, or agency relationship between SnowLawn and any user (Customer or Provider). No user has the authority to bind SnowLawn or make representations on SnowLawn's behalf. SnowLawn does not act as an agent, broker, or representative for any Provider or Customer.
3. No Guaranty or Liability
SnowLawn assumes no guaranty, warranty, or liability of any kind for the services performed by Providers, including but not limited to:
- The quality, safety, timeliness, or completeness of any services performed
- Property damage arising from services rendered by Providers
- Personal injury occurring during or as a result of services
- The accuracy of Provider profiles, descriptions, qualifications, or reviews
- Any financial loss arising from transactions between Customers and Providers
- Provider licensing, insurance, bonding, or regulatory compliance
- Service outcomes, including slip-and-fall incidents on serviced properties
All services arranged through the Platform are provided "AS IS" without any warranty, express or implied. SnowLawn expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
4. No Background Checks or Provider Vetting
SnowLawn does NOT conduct background checks, criminal history checks, identity verification, reference checks, or any other form of vetting on Providers or Customers. SnowLawn does not independently verify any Provider's identity, qualifications, licenses, insurance, bonding status, or business registration, beyond confirming that a business claiming a listing controls that listing's phone number or email address.
Provider profiles, ratings, reviews, and any displayed information are user-generated content and may not be accurate. You are solely responsible for independently verifying a Provider's or Customer's identity, qualifications, and suitability before engaging in any transaction.
5. Independent Service Providers
All Providers on the Platform are independent contractors. They are not employees, agents, or representatives of SnowLawn. SnowLawn does not control, direct, or supervise Providers' work. Each Provider is solely responsible for:
- Their own federal, state, and local taxes, including self-employment taxes; payments received through the Platform may be reported to tax authorities (e.g., on Form 1099-K by our payment processor) where legally required
- Maintaining applicable licenses, permits, and insurance
- Complying with all applicable federal, state, and local laws and regulations
- The quality and safety of services provided
- Providing accurate and truthful information on their profiles
- Any warranties or guarantees they choose to offer directly to Customers
6. Customer Responsibilities
As a Customer, you acknowledge and agree that:
- You are hiring an independent Provider, not SnowLawn, for services
- You are responsible for verifying a Provider's qualifications, insurance, and suitability for your needs
- You assume all risk associated with services performed on your property
- Any dispute regarding service quality is between you and the Provider
- You will provide accurate property information and safe access for service delivery
- You are responsible for payment of agreed-upon service fees
6b. Assumption of Risk & Release of Claims
BY USING THE PLATFORM, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SERVICES ARRANGED THROUGH THE PLATFORM, INCLUDING BUT NOT LIMITED TO RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, DEATH, FINANCIAL LOSS, AND UNSATISFACTORY SERVICE OUTCOMES.
To the fullest extent permitted by law, you hereby release, waive, and discharge SnowLawn, its officers, directors, employees, agents, and affiliates from any and all claims, demands, causes of action, damages, losses, and liabilities of any kind, whether known or unknown, arising from or in connection with services arranged through the Platform. This release applies to claims arising from the negligence, acts, or omissions of any Provider or Customer, as well as claims arising from the use of the Platform itself.
7. Payment Processing
SnowLawn facilitates payment processing between Customers and Providers through third-party payment processors (e.g., Stripe). For transactions processed through the Platform, Customers pay SnowLawn a service fee for facilitating the transaction — currently 5% of the service price, at most $6.95, added to the service price: on a single job, 5% of that booking's price, at most $6.95 per booking; on a season (a mowing season, a winter of snow removal or any other season, whether booked or accepted from a quote; each season of a year-round lawn and snow quote is its own season), 5% of the season's price, at most $6.95, charged once, with the season's first payment or visit (its later payments and visits carry no service fee) — and Providers pay card processing at a standard rate — currently 2.9% of the service price plus 30¢ per transaction, whatever card the Customer uses — deducted from the Provider's payout. Card processing is not deducted on a job priced before the Provider's listing was claimed on the Platform, including every payment and visit of a season priced then; SnowLawn pays it. A Provider may instead choose, on a quote or when it accepts a booking request made with Book Now, to be paid by the Customer directly: the Customer then accepts the quote, or the booking is confirmed, without a card, and the Customer pays the Provider, outside the Platform, the price plus the same service fee (5% of the price, at most $6.95; once for a season; for each season of a year-round lawn and snow quote); no payment for that job runs through the Platform and no card processing applies; and the Provider prepays that service fee to SnowLawn, charged to the Provider's card on file when, and only when, the Customer accepts the quote or the booking is confirmed. Apart from that prepaid service fee, SnowLawn charges Providers no other per-transaction fee. The SnowLawn business toolkit is free for at least 6 months, which start when a business is claimed or, where the claim does not start them, when the business starts them from the Billing page after the claim, after which the business keeps the free plan unless it chooses Pro at $7.95/month; the listing itself remains free. Current rates are shown at booking and on the Billing page and may change with notice. SnowLawn is not responsible for:
- Payment disputes between Customers and Providers
- Refund decisions — these are resolved between the Customer and Provider
- Errors caused by third-party payment processors
- Unauthorized transactions resulting from compromised account credentials
7b. Cancellation & Refund Policy
Cancellation and refund policies are determined by individual Providers, not by SnowLawn. SnowLawn is a transaction facilitator: it does not make refund or cancellation decisions, does not guarantee the work, and does not promise refunds. The following applies to cancellations:
- If you cancel before the job is completed, the authorization hold on your card is released in full — nothing is charged
- After a job is completed and charged, any refund is agreed between the Customer and the Provider
- Disputes regarding refunds must be resolved directly between the Customer and Provider
- SnowLawn's service fee is charged only with a charge for the service — a completed job, or a season's first payment or visit; if a charge is refunded through the Platform, the service fee on that charge is refunded with it
- The service fee a Provider prepays on a quote, or on a booking made with Book Now, that the Customer pays directly is charged to the Provider when the Customer accepts the quote or the booking is confirmed; it is refunded to the Provider if the booking is cancelled, or ends with the Provider unable to access the property, before the job is done; for a season, only its agreement decides: the fee is refunded if the agreement is cancelled before the Customer signs it or, for a season booked with Book Now, before any of its visits is done
- SnowLawn may, at its sole discretion, mediate payment disputes but is not obligated to do so
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNOWLAWN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR SERVICES ARRANGED THROUGH THE PLATFORM.
SnowLawn's total aggregate liability to you for all claims arising from your use of the Platform shall not exceed the total amount of fees of any kind (service fees, card-processing charges and subscription fees) you paid to SnowLawn in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless SnowLawn and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform
- Services you provide or receive through the Platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any dispute between you and another user of the Platform
10. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify SnowLawn of any unauthorized use of your account. SnowLawn reserves the right to suspend or terminate accounts that violate these Terms.
11. Platform Communications Between Users
The Platform provides an in-app messaging system for Customers and Providers to communicate regarding bookings and services. By using this messaging feature, you acknowledge and agree to the following:
- No Expectation of Privacy: Messages sent through the Platform are stored on SnowLawn's servers and may be accessed, reviewed, or disclosed by SnowLawn for purposes including platform safety, dispute resolution, legal compliance, abuse prevention, and service improvement. Do not treat in-platform messages as private communications.
- Message Retention: SnowLawn retains messages for the duration of your account and for a reasonable period after account deletion, as necessary for legal, audit, or dispute resolution purposes.
- Content Responsibility: You are solely responsible for the content of messages you send. SnowLawn does not pre-screen, moderate, or endorse user-to-user messages and is not liable for any content sent by one user to another.
- Prohibited Message Content: You shall not use the messaging system to send harassment, threats, hate speech, sexually explicit content, spam, advertisements for competing services, or any illegal content. Violation may result in immediate account termination.
- Off-Platform Communications: SnowLawn has no responsibility, liability, or obligation regarding any communications that occur outside of the Platform between users, whether by phone, email, text message, in person, or through any other channel. Any off-platform interactions are entirely at your own risk.
12. Acceptable Use & Prohibited Conduct
You agree not to use the Platform for any unlawful purpose or in violation of these Terms. The following conduct is strictly prohibited:
- Providing false, misleading, or fraudulent information in your profile, listings, or reviews
- Posting fake reviews or manipulating ratings
- Harassing, threatening, or abusing other users
- Discriminating against any user based on race, gender, religion, national origin, disability, or other protected characteristics
- Spamming, soliciting, or sending unsolicited communications through the Platform
- Scraping, crawling, or using automated means to access the Platform without authorization
- Interfering with or disrupting the Platform's infrastructure or security
- Impersonating another person, business, or entity
- Using the Platform to facilitate any illegal activity
- Sharing account credentials with unauthorized third parties
13. Account Suspension & Termination
SnowLawn reserves the right to suspend, restrict, or permanently terminate your account, with or without notice, for any of the following reasons:
- Violation of these Terms or any applicable law
- Engaging in prohibited conduct as described in Section 12
- Repeated negative reviews or verified complaints from other users
- Fraudulent, deceptive, or harmful behavior
- Non-payment of platform fees or chargebacks
- Failure to maintain required Provider licenses or insurance
- Extended inactivity (accounts inactive for more than 24 months may be deleted)
- At SnowLawn's sole discretion for any reason, with 30 days' notice for accounts in good standing
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) shall survive.
14. Intellectual Property & Content
The SnowLawn Platform, including its design, logos, text, graphics, and software, is owned by SnowLawn and protected by copyright, trademark, and other intellectual property laws.
User Content: By submitting content to the Platform (including reviews, photos, profile information, and messages), you grant SnowLawn a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating the Platform. You retain ownership of your content but are responsible for ensuring you have the right to submit it.
Copyright Complaints: If you believe content on the Platform infringes your copyright, contact us at admin@snowlawn.net with: (a) a description of the copyrighted work, (b) identification of the infringing material, (c) your contact information, and (d) a statement of good faith belief that the use is unauthorized.
15. Dispute Resolution
Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Any arbitration shall be conducted in the State of New Hampshire. You waive your right to a jury trial and to participate in a class action lawsuit.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration against SnowLawn.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.
16. Statute of Limitations
You agree that any claim or cause of action arising out of or relating to your use of the Platform or these Terms must be filed within one (1) year after the claim arose. Any claim filed after this one-year period is permanently barred. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.
17. Electronic Communications Consent
By creating an account, you consent to receive electronic communications from SnowLawn, including emails, push notifications, and in-app messages. You agree that any notices, agreements, disclosures, or other communications delivered electronically satisfy any legal requirement that such communications be in writing. This consent is provided in accordance with the federal E-SIGN Act (15 U.S.C. § 7001 et seq.) and applicable state laws.
18. SMS/Text Message Consent (TCPA)
By providing your phone number and creating an account, you expressly consent to receive text messages (SMS and MMS) from SnowLawn and its service providers at the phone number you provided. These messages may include:
- Booking confirmations, schedule changes and on-the-way alerts — where a Provider has enabled it, one text when their crew is about ten minutes from your service address on the day of a scheduled visit; the text never contains the crew's location
- Quotes and messages from Providers; for Providers, new quote requests, booking offers and messages from Customers
- Account verification codes
- Payment notices that need your action (a declined or unconfirmed card, an invoice)
- Short surveys about your experience
Message and data rates may apply. Message frequency varies. Text HELP for help. Carriers are not liable for delayed or undelivered messages. Replying STOP to any SnowLawn text stops all texts to that number — including booking, verification and payment texts — until you reply START. To turn off marketing texts only, use the "Marketing texts" setting in your account. Because verification codes are sent by text, stopping all texts may limit your ability to sign in or use certain Platform features. Consent to receive text messages is not a condition of purchasing any goods or services.
19. Modification of Terms
SnowLawn reserves the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law principles.
21. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
22. Entire Agreement
These Terms, together with the Privacy Policy and Platform Disclaimer, constitute the entire agreement between you and SnowLawn regarding your use of the Platform. These Terms supersede any prior agreements, communications, or understandings, whether written or oral.
23. Waiver
The failure of SnowLawn to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by SnowLawn.
24. Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without the prior written consent of SnowLawn. SnowLawn may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
25. No Third-Party Beneficiaries
These Terms are intended solely for the benefit of the parties hereto and are not intended to confer any rights or remedies upon any third party. No third party shall have the right to enforce any provision of these Terms.
26. Notice Provisions
SnowLawn may provide notices to you via email to the address associated with your account, through in-app notifications, or by posting on the Platform. You agree that these methods constitute adequate legal notice. Notices from you to SnowLawn must be sent to admin@snowlawn.net and are deemed given when actually received.
27. Force Majeure
SnowLawn shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, severe weather events, or any other event that is beyond SnowLawn's reasonable control.
